Terms of Service

These Terms of Service (“Terms”, “Agreement”) govern access to and use of the sales enablement software, browser extensions, websites, and associated application programming interfaces (APIs) provided by Buildflow Inc. (“Buildflow”, “we”, “us”, or “our”). By creating an account, installing or using the Buildflow Chrome Extension, accessing the web dashboard at buildflowhq.com, or utilizing our APIs, you (“Customer”, “User”, or “you”) agree to be legally bound by this Agreement. If you are entering into this Agreement on behalf of an entity or employer, you represent and warrant that you possess the legal authority to bind that entity.

1. Description of the Services

Buildflow operates an integrated B2B sales intelligence and outreach enablement platform consisting of:

  • The Web Dashboard: Hosted at buildflowhq.com and associated subdomains, providing onboarding, product catalog repositories, and an outline-first sales presentation generator and editor.
  • The Buildflow Chrome Extension:A Manifest V3 browser side-panel designed to extract publicly visible profile and company context from professional networking pages (such as LinkedIn) and synchronize data with the user’s dashboard.
  • Intelligence & Enrichment Services: Automated firmographic lookup, qualification scoring, AI-powered message generation, website color-theme extraction, and PDF/PowerPoint (.pptx) export pipelines.

2. Eligibility and Account Registration

Commercial B2B Platform Only: Buildflow is strictly a commercial business-to-business (B2B) platform. It is not intended for consumer use or for individuals under the age of eighteen (18). By registering an account, you affirm that you are at least 18 years old and acquiring access solely for professional purposes.

Authentication is managed securely via enterprise identity protocols and delegated authorization engines. You are responsible for maintaining the confidentiality of your login credentials and session tokens. You must notify Buildflow immediately at privacy@buildflowhq.com if you suspect unauthorized access to your account.

3. License Grant and Permitted Use

Subject to compliance with this Agreement and timely payment of applicable subscription fees, Buildflow grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the platform and browser extension for your internal business operations.

Chrome Extension Limited Use Compliance: The Buildflow Chrome Extension is provided for the single purpose of streamlining B2B sales prospecting by capturing prospect context and generating outreach intelligence. The extension only runs DOM extractions when triggered by page detection or manual user action. Buildflow does not record, sell, or transmit non-sales browsing activity, general browsing history, or keystrokes.

4. Proprietary Rights and Ownership

Buildflow Intellectual Property: Buildflow and its licensors retain all right, title, and interest in and to the platform, web application, browser extensions, backend microservices, documentation, template designs, and underlying code.

Customer Content & Product Catalog: You retain complete ownership of all data, text, product catalogs, value propositions, trademarks, and files uploaded or submitted to Buildflow. You grant Buildflow a limited license to host and process this content solely to deliver the services.

Generated Sales Decks and Outreach Copy: You own all rights, title, and interest in the customized outreach drafts, tailored talking points, and presentation files (PDF and PPTX formats) generated through your tenant.

5. Third-Party Platforms and Compliance

The Services interact with third-party web platforms, including LinkedIn. You acknowledge and agree that:

  • Compliance Responsibility: You are solely responsible for ensuring that your use of the Buildflow Chrome Extension complies with the terms of service, acceptable use policies, and guidelines of any third-party website or platform you navigate.
  • No Endorsement: Buildflow does not warrant that your use of third-party platforms will be uninterrupted or error-free, nor does Buildflow claim any affiliation or endorsement by LinkedIn Corporation or other external networks.
  • Enrichment Accuracy: Buildflow uses automated crawlers and market data providers to resolve publicly available corporate firmographics, but does not guarantee the complete accuracy or real-time availability of third-party public database information.

6. Artificial Intelligence and Machine Learning Features

Buildflow incorporates advanced Large Language Models (LLMs) to synthesize sales talking points, generate pitch outlines, and structure presentation layouts. You acknowledge that generative AI models may occasionally produce inaccurate, incomplete, or varied outputs. You are responsible for reviewing and verifying all AI-generated copy and presentation materials prior to sending them to prospective clients.

Enterprise AI Safeguards: Your proprietary Customer Content, company product features, and prospect details are never used to train, retrain, or fine-tune public foundation AI models. Data transmitted to authorized AI endpoints is processed strictly for the transient window necessary to deliver the requested generation output.

7. Data Protection and Roles

Data Controller vs. Data Processor: To the extent that prospect profile information, contact leads, or personal data are processed through the platform, you act as the Data Controller, determining the purpose and legal basis for collecting and reaching out to leads. Buildflow acts as a Data Processor, processing such data strictly on your behalf, in accordance with your instructions, our Privacy Policy, and applicable data protection regulations (including GDPR and CCPA/CPRA).

Buildflow implements industry-standard technical and organizational security controls, including TLS 1.3 encryption for data in transit, AES-256 encryption for data at rest, role-based access control, and automated token invalidation.

8. Acceptable Use and Prohibited Activities

You agree not to engage in any of the following prohibited activities:

  • System Abuse: Interfering with, compromising, or overburdening platform infrastructure, API endpoints, or connected networks.
  • Security Probing: Circumventing security measures, testing vulnerability vectors without prior written authorization, or accessing data belonging to other tenants.
  • Malicious Messaging: Using generated content to transmit unlawful spam, defamatory content, harassment, phishing campaigns, or materials that violate anti-spam legislation (such as the CAN-SPAM Act).
  • Data Reselling: Selling, renting, sublicensing, or providing third-party access to raw data, platform outputs, or services without explicit written authorization.

9. Subscriptions, Invoicing, and Cancellation

Access to specific tiers of the service (including seat allocations, presentation export limits, and AI inference quotas) requires an active paid subscription. Subscriptions are billed in advance on a recurring monthly or annual basis. Fees are non-refundable except where required by applicable law. Subscriptions automatically renew at the conclusion of each billing period unless cancelled through your dashboard prior to the renewal date. Payments are processed via third-party certified payment processors; Buildflow does not store full credit card numbers directly on its servers.

10. Term, Suspension, and Termination

This Agreement commences on the date you first access the service and continues until terminated by either party. You may terminate your account at any time by navigating to your Account Settings or notifying us at privacy@buildflowhq.com. We reserve the right to suspend or terminate your account immediately if you materially breach any provision of this Agreement, if required by applicable law, or if your ongoing use poses a security risk to the infrastructure. Upon termination, your right to use the platform will immediately cease, and all account data is purged within 30 days, except where retention is legally mandated.

11. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Buildflow platform, browser extension, APIs, and generated materials are provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, statutory, or otherwise. Buildflow expressly disclaims all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the service will be uninterrupted, secure, accurate, or error-free.

12. Limitation of Liability

To the maximum extent permitted by law, in no event shall Buildflow Inc., its affiliates, directors, employees, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, data loss, or business opportunity). In no event shall Buildflow’s total cumulative liability under this agreement exceed the total amount paid by you to Buildflow in the twelve (12) months preceding the event giving rise to the claim.

13. Indemnification

You agree to defend, indemnify, and hold harmless Buildflow Inc., its officers, directors, employees, and agents from and against any third-party claims, damages, liabilities, losses, and reasonable legal fees arising out of or related to your violation of this Agreement, your Customer Content, or your violation of third-party rights or platform terms.

14. Changes to these Terms

We may modify this Agreement periodically to reflect service enhancements, platform feature rollouts, or evolving legal requirements. When modifications are material, we will provide advance notice by updating the ‘Last Updated’ timestamp, posting a notice on the dashboard, or dispatching an email notification. Continued access to or use of the Services following the effective date of updated Terms constitutes your binding acceptance.

15. Governing Law and Dispute Resolution

This Agreement is governed by and construed in accordance with the laws of the jurisdiction in which Buildflow Inc. is incorporated, without regard to conflict of law principles. If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
